FMS Attorney Rich Scrugham represented the Trustee of the Trust and appealed the trial court’s interpretation of certain provisions regarding Trust payments to the decedent’s widow (and second wife). Mr. Scrugham’s clients (the Trustee and the children of the decedent) also appealed the trial court’s ruling regarding the use of the main Trust asset – a home in Sevier County.
The Court of Appeals reversed the trial court’s interpretation of the Trust terms, and reduced the award to the decedent’s widow from approximately $160,000 to $20,000.
